However my main concern at the moment is to seek clarification from EBC enforcement that you now intend to issue a formal enforcement notice for removal of the unauthorised hard standing in a Flood Zone 3. On the 30 of April 2007 EBC enforcement stated that this hard standing would not be subject to enforcement action as it was seen as  reinstatement of the land which previously contained mature trees and vegetation. I understand from communication with the Environment Agency that EBC enforcement have since informed the EA that this hard standing will be subject to enforcement action. Hence I would be grateful if you could clarify in writing that this is indeed your intention. The 30 of April 2007 letter from your department also stated the EA was consulted over the hard standing remaining and they raised no objections. I would be grateful if you could provide further details of this EA communication as I understand from the EA that they in fact still object to this unauthorised hard standing. I am anxious to establish culpability for my legal insurers should I flood as a direct result of this hard standing with no drainage system 3 metres away from my property.
